Ningún contenido publicado constituye asesoría legal, financiera o profesional.

2. Elegibilidad del Usuario

Para utilizar el Sitio Web y contratar los servicios, el usuario declara y garantiza que tiene al menos 18 años de edad, cuenta con capacidad legal para contratar y que toda la información proporcionada es veraz, completa y actualizada en todo momento.

3. Uso del Sitio Web y Responsabilidad

El usuario se compromete a utilizar el Sitio Web de forma lícita, sin proporcionar información falsa o interferir con su funcionamiento. 4. Uso de Inteligencia Artificial y Respuestas Automatizadas

El sitio web podrá utilizar herramientas de IA, chatbots y sistemas automatizados para brindar orientación inicial. El usuario acepta que dichas respuestas son automatizadas, meramente informativas y no constituyen asesoría legal ni sustituyen la revisión humana. 5. Tratamiento de la Información, Datos Personales y Comunicaciones

El usuario autoriza expresamente a Migrando Fácil a recolectar, almacenar y procesar la información personal y sensible proporcionada (incluyendo, de manera enunciativa mas no limitativa: nombre, correo electrónico, número telefónico, historial migratorio, estados financieros y cualquier documento necesario para la gestión de su caso). El tratamiento de estos datos se rige bajo las siguientes condiciones:

-Finalidades del Tratamiento: La información será utilizada para: (a) Brindar actualizaciones, notificaciones y alertas relacionadas con los servicios; (b) Preparación de formularios y gestión administrativa ante autoridades; (c) Enviar comunicaciones informativas o comerciales; (d) Mejorar la experiencia del usuario y realizar análisis internos; (e) Compartir información con proveedores tecnológicos o terceros aliados estrictamente necesarios para la ejecución del servicio.

-Seguridad y Confidencialidad: Migrando Fácil implementa medidas de seguridad técnicas y administrativas para proteger sus datos. No obstante, el cliente acepta que las comunicaciones digitales no son 100% invulnerables y asume el riesgo inherente. La empresa no vende ni cede sus datos a terceros para fines de marketing ajenos a nuestra operación.

-Veracidad de la Documentación: El cliente garantiza que toda la información y documentos que se entreguen o puedan ser entregados (entiendase por entregados, aquellos documentos que lleguen a Migrando Facil de manera física y/o digital) son veraces y auténticos. Migrando Fácil no asume la obligación de peritaje documental y no será responsable por las consecuencias legales o administrativas derivadas de información falsa o incompleta proporcionada por el usuario.

-Derechos de Privacidad y Retención de Datos: El usuario puede solicitar el acceso, corrección o eliminación de su información personal conforme a la legislación aplicable en los Estados Unidos. Sin embargo, el usuario acepta que Migrando Fácil conservará copia de toda la información y registros de servicio (incluyendo logs de IP y confirmaciones de envío) durante el tiempo que sea necesario para cumplir con obligaciones fiscales, auditorías a las que pudiera ser requerido y/o para ser utilizados como evidencia de cumplimiento ante posibles disputas bancarias o contracargos.

-Canal Único de Solicitudes: Para que cualquier solicitud relacionada con sus datos sea válida, deberá enviarse exclusivamente al correo electrónico oficial detallado en la Cláusula 13 (Notificaciones Oficiales).

6. Servicios y Entregables

Los servicios incluyen, de manera enunciativa mas no limitativa, la preparación de formularios migratorios, entrega de borradores digitales, apoyo administrativo y traducciones. Los entregables específicos variarán según el paquete contratado y se darán por cumplidos una vez puestos a disposición del cliente por los medios digitales definidos por la empresa.

7. Pagos, Tarifas y Notificación de Inicio

Todos los servicios requieren el pago total y anticipado para iniciar cualquier gestión. Los precios están sujetos a cambios hasta que se complete la transacción. El cliente reconoce que el inicio del servicio y la confirmación del pago se perfeccionan y se dan por debidamente notificados mediante el envío de un correo electrónico por parte de Migrando Fácil. Esta comunicación electrónica constituye la prueba fehaciente de la materialización del servicio para fines de aclaración ante instituciones bancarias o procesadores de pago. Salvo lo dispuesto en la cláusula de cancelaciones, todos los pagos son definitivos y no reembolsables debido a la naturaleza de propiedad intelectual del servicio.

8. Gestión de Comisiones y Métodos de Pago

Los pagos mediante tarjetas o plataformas de terceros (Stripe, PayPal, Venmo, etc.) pueden generar comisiones de procesamiento o cargos transfronterizos ajenos a Migrando Fácil. Estas comisiones son cobradas directamente por los proveedores financieros y no forman parte de nuestros honorarios, por lo que no son reembolsables. El cliente podrá optar por métodos de pago directos (transferencias bancarias nacionales o envíos directos entre apps) para mitigar estos cargos, previa solicitud de instrucciones a través del medio oficial de contacto.

9. Políticas de Cancelación y Reagenda

El derecho a solicitar la cancelación se limita a un plazo de 24 horas tras la notificación de inicio del servicio (enviada por Migrando Fácil vía correo electrónico), siempre que no se haya comenzado el análisis o preparación del caso. Para que dicha solicitud de cancelación sea válida, el cliente deberá enviarla obligatoriamente por correo electrónico según lo establecido en la Cláusula 13. Las citas de asesoría podrán reagendarse con 24 horas de antelación; la inasistencia o cancelación tardía resultará en la pérdida de la cita sin derecho a reembolso.

10. Blindaje contra Contracargos y Disputas

El cliente se compromete a no iniciar procesos de contracargo (chargebacks) sin antes agotar la resolución directa con Migrando Fácil vía correo electrónico. El inicio de un contracargo injustificado (por cambio de opinión o demoras de USCIS) se considera un incumplimiento contractual grave. Migrando Fácil utilizará estos términos y las notificaciones de envío de servicio como evidencia legal ante el banco. El cliente asumirá cualquier costo legal o penalización derivada de disputas fallidas.

11. Limitación de Responsabilidad y Tiempos Oficiales

Migrando Fácil no garantiza resultados ni plazos específicos, ya que los tiempos de procesamiento dependen exclusivamente de USCIS u otras agencias gubernamentales. No seremos responsables por negaciones, retrasos externos, fallas técnicas ajenas o daños indirectos. Nuestra responsabilidad total se limita al monto efectivamente pagado por el usuario por el servicio en cuestión.

12. Propiedad Intelectual

Todo el contenido del Sitio Web (textos, software, logotipos, diseños) es propiedad exclusiva de Migrando Fácil. Queda prohibida su reproducción o uso no autorizado sin consentimiento previo y por escrito de los titulares.

13. Notificaciones Oficiales y Contacto

Para garantizar la seguridad jurídica de ambas partes, se establece el siguiente régimen de comunicaciones:

-De Migrando Fácil al Cliente: Nosotros podremos notificarle por cualquier medio disponible (correo electrónico, WhatsApp, SMS o mensajes en la plataforma). Sin embargo, las notificaciones relativas a pagos, confirmación de servicios y cambios en términos se realizarán prioritariamente vía correo electrónico.

-Del Cliente a Migrando Fácil: Para que cualquier notificación, solicitud de cancelación, reclamo, ejercicio de derechos de datos o comunicación legal sea considerada válida y vinculante, el cliente deberá enviarla única y exclusivamente al correo electrónico oficial: contacto@migrandofacil.com. No se reconocerán como válidas las notificaciones enviadas por redes sociales, chats o cualquier otro medio distinto al aquí señalado.

14. Ley Aplicable y Arbitraje

Estos Términos se rigen por las leyes del Estado de Pensilvania y la legislación federal de EE. UU. Cualquier disputa se resolverá de manera definitiva mediante arbitraje individual ante la American Arbitration Association (AAA) en Pensilvania. El usuario renuncia expresamente a su derecho de participar en demandas colectivas (class actions) o juicios por jurado.

The user acknowledges that Migrando Fácil depends exclusively on the information provided by the client; therefore, any error, delay, or negative consequence derived from incorrect or incomplete information shall be the sole responsibility of the user. 4. Use of Artificial Intelligence and Automated Responses

The Website may use AI tools, chatbots, and automated systems to provide initial guidance. The user accepts that such responses are automated, merely informative, and do not constitute legal advice or replace human review. Any decision made based on these responses shall be the sole responsibility of the user, releasing Migrando Fácil from any liability regarding incorrect interpretations.

-Purposes of Processing: Information will be used to: (a) Provide updates, notifications, and alerts related to the services; (b) Prepare forms and manage administrative tasks before authorities; (c) Send informative or commercial communications; (d) Improve user experience and conduct internal analysis; (e) Share information with technology providers or allied third parties strictly necessary for service execution.

-Security and Confidentiality: Migrando Fácil implements technical and administrative security measures to protect your data. However, the client acknowledges that digital communications are not 100% invulnerable and assumes the inherent risk. The company does not sell or lease your data to third parties for marketing purposes outside of our operation.

-Accuracy of Documentation: The client guarantees that all information and documents provided or that may be provided (defined as those received by Migrando Fácil physically and/or digitally) are truthful and authentic. Migrando Fácil does not assume an obligation for forensic document examination and shall not be held liable for legal or administrative consequences arising from false or incomplete information provided by the user.

-Privacy Rights and Data Retention: The user may request access, correction, or deletion of their personal information in accordance with applicable U.S. laws. However, the user agrees that Migrando Fácil will retain copies of all information and service records (including IP address logs and delivery confirmations) for as long as necessary to comply with tax obligations, any required audits, and/or to be used as evidence of compliance in the event of potential banking inquiries or chargeback disputes.

-Sole Channel for Requests: For any request related to your data to be valid, it must be submitted exclusively to the official email address detailed in Clause 13 (Official Notifications).

6. Services and Deliverables

Specific deliverables will vary according to the contracted package and will be deemed fulfilled once made available to the client through the digital means defined by the company.

7. Payments, Fees, and Notice of Commencement

All services require full and advance payment to begin any management. Prices are subject to change until the transaction is completed. The client acknowledges that the commencement of service and payment confirmation are perfected and deemed duly notified upon the sending of an email by Migrando Fácil. This electronic communication constitutes conclusive evidence of the materialization of the service for clarification purposes before banking institutions or payment processors. Except as provided in the cancellation clause, all payments are final and non-refundable due to the intellectual property nature of the service.

8. Commission Management and Payment Methods

Payments made via credit cards or third-party platforms (Stripe, PayPal, Venmo, etc.) may incur processing fees or cross-border charges external to Migrando Fácil. These fees are collected directly by financial institutions or payment processors and are not part of our professional fees; therefore, they are non-refundable. The client may opt for direct payment methods (domestic bank transfers or direct app-to-app transfers) to mitigate these charges, subject to requesting specific instructions through the official contact method.

9. Cancellation and Rescheduling Policies

The right to request cancellation is limited to a 24-hour window following the notice of commencement of service (sent by Migrando Fácil via email), provided that the analysis or preparation of the case has not begun. For such a cancellation request to be valid, the client must mandatory send it by email as established in Clause 13. Consulting appointments may be rescheduled with 24 hours' notice; failure to attend or late cancellation will result in the loss of the appointment without right to compensation.

10. Protection Against Chargebacks and Disputes

The client agrees not to initiate chargeback processes or disputes without first exhausting direct resolution with Migrando Fácil via email. Initiating an unjustified chargeback (due to change of mind or USCIS delays) is considered a material breach of contract. Migrando Fácil will use these terms and service delivery notifications as legal evidence before the bank. The client shall bear any legal costs or penalties resulting from failed disputes.

11. Limitation of Liability and Official Timelines

Migrando Fácil does not guarantee specific results or timelines, as processing times depend exclusively on USCIS or other government agencies. We shall not be liable for denials, external delays, technical failures, or indirect damages. Our total liability is limited to the amount effectively paid by the user for the specific service.

12. Intellectual Property

All Website content (text, software, logos, designs) is the exclusive property of Migrando Fácil. Unauthorized reproduction or use without prior written consent from the owners is strictly prohibited.

13. Official Notifications and Contact

To ensure legal certainty for both parties, the following communication regime is established:

-From Migrando Fácil to the Client: We may notify you through any available means (email, WhatsApp, SMS, or platform messages). However, notifications regarding payments, service confirmations, and changes to terms will be conducted primarily via email.

-From the Client to Migrando Fácil: For any notification, cancellation request, claim, exercise of data rights, or legal communication to be considered valid and binding, the client must send it solely and exclusively to the official email: contacto@migrandofacil.com. Notifications sent via social media, chats, or any other medium will not be recognized as valid.

14. Governing Law and Arbitration

These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable U.S. federal law. Any dispute shall be finally resolved through individual binding arbitration before the American Arbitration Association (AAA) in Pennsylvania. The user expressly waives their right to participate in class actions or jury trials.
